Terms and conditions

This page details the terms and conditions that apply to your contract with Solid DNS.

If you think any of these terms are unreasonable, do let us know and maybe we will change them.

Definitions

  • Solid DNS: a trade name of Solid Links, located in the Netherlands, registered in the Dutch Chamber of Commerce under number 32144570.
  • Customer: the individual or company that has entered into a contract with Solid DNS
  • Service: the services as provided by Solid DNS, in the widest possible definition
  • Terms and conditions: this document

Contract

By signing up, the customer enters into a legally binding contract with Solid DNS, under these terms and conditions. Solid DNS does not accept any terms and conditions of the customer.

Exceptions

Any exceptions to these terms and conditions, granted by Solid DNS to the customer, are only valid if made in writing. Previous exceptions do not gain the customer any right to future exceptions.

Acceptable use

The customer is not allowed to use the service in a way that causes harm to Solid DNS or others. The service may not be used for activities prohibited by law or other regulations, or to facilitate or assist with such actions. For example, but not limited to: the service may not be used to host domains that are used for sending unsolicited bulk communications.

Liability

The maximum liability of Solid DNS, its suppliers, resellers, employees and other related parties, in any possible situation, shall be limited to three times the monthly fee of the service to which the claim refers, at the time of the claim.

Solid DNS can not be held liable for any damage that in some way is a result of force majeure, including, but not limited to: weather conditions, lightning strike, flooding, civil unrest, war, strike, acts of terrorism, riots or fires, except in the case of gross negligence.

Solid DNS can not be held liable for any indirect damages, including, but not limited to: loss of profit or loss of customers. Solid DNS can only be held liable for direct damages, such as costs for a reasonable alternative service in the case of serious outages of Solid DNS.

Changes to the terms and conditions

Solid DNS may change these terms and conditions. If that happens, a notice will be sent to all users, at least 30 days before the new terms and conditions apply, except if the change is a consequence of laws or regulations that have to be applied in less time.

Billing and service suspension

Solid DNS works solely on a prepaid system. Funds deposited by the customer are converted to credits. Credits will be deducted in advance for providing the service. If there are insufficient credits in the customer's account, service will be partially or fully suspended.

VAT will be added to the total amount when credits are purchased, except when the customer is a registered business in the European Union with a valid VAT number, or is located outside of the European Union. Validity of VAT numbers will be solely determined by Solid DNS, who will verify them with the Dutch tax authorities.

Notices

Notices, for example, but not limited to, violations of the terms and conditions or service suspensions, shall be sent to the customer's primary and, if present, secondary e-mail address. The customer is responsible for keeping any entered addresses functional and up to date.

If no bounce is received from an e-mail address, the customer is assumed to have received the sent e-mail. It is the customer's responsibility to assure such e-mail is read.

Responsibilities for the customer

Security

The customer shall handle his account data (user name and password) with care. The customer shall not provide his password to third parties. The customer will be held liable for any damages or abuse related to a third party gaining access to the customer's account, if this is due to the customer not treating his account data with sufficient and reasonable care.

Accuracy of data

The customer must provide complete and accurate data for his account.

If incorrect data is found in a customer's account, the customer will be asked to correct this. If the data is not corrected, the account may be terminated after a notice period of 30 days.

An exception to this is an invalid VAT number or invalid country set for an account. If the customer is using an invalid VAT number or has entered an invalid country, which may be to avoid being charged VAT, the account can be terminated immediately and permanently.

Account termination

An account may be terminated in any of the following conditions:

User request
After logging in, a customer can request cancellation of the account.
Very low account balance for more than 60 days
If the account balance on the customer's account is such that it is too low to purchase any service, for more than 60 days, the account can be terminated. The customer will receive at least two notifications before this.
Gross violation of terms and conditions
If the customer is found in gross violation of these terms, the account can be terminated immediately. In this case, Solid DNS will send a notification with details of the violation.
In less serious cases, a warning will be given. If the violation is not stopped after the warning, Solid DNS can also terminate the account.
Account with false data
Please see the section "Accuracy of data" for more information.
Any other reason
Solid DNS may terminate the service for any other reason, after a notice period of at least 90 days.

As soon as the account is terminated, the service for the customer will stop. The customer will no longer be able to log in. Credits remaining in the account will not be returned.

Other

The invalidation of any (part of an) article or of these terms and conditions will not affect the validity of any other (part of an) article.

The relationship between the customer and Solid DNS is governed exclusively by Dutch law, and falls under the exclusive jurisdiction of Dutch courts.
